You can contact us about anything in this policy at dataprotection@legacypep.co.uk, or by post to the address above.

Legacy Probate is one of a family of estate planning businesses, alongside its associated companies Legacy Wills & Estate Planning Limited, Legacy Executor Services Limited and Legacy Home Protect Limited. Each company is separate and is responsible for the personal information it holds.

The information we collect

When you enquire or book a consultation. If you use our contact form, book a consultation, call or email us, we collect your name, phone number, email address, your preferred days and times for a call where you give them, and anything you choose to tell us about your situation.

When you become a client. To provide our Probate Application Service we collect the information needed to prepare the probate application, including your contact details, your role in the estate, and the information about the estate that you supply to us, such as details of assets, liabilities, property and financial accounts. We may also collect identification information to verify who we are dealing with.

Information about other people. The nature of probate means the information you give us will often include details about other people, such as the person who has died, beneficiaries and other executors. Where you provide information about living people, please make sure you are able to share it with us. Data protection law applies to information about living people. We nonetheless treat information about the person who has died with the same care and confidentiality.

Estate searches. Where an estate search forms part of your service, we and our search providers process information about the person who has died in order to help identify assets and liabilities.

How we use your information, and why we are allowed to

We use your information to respond to your enquiry and arrange your free consultation, to provide our Probate Application Service under our agreement with you, to prepare your written quotation and Letter of Engagement, to refer you, only with your consent, to a panel solicitor where legal advice or full estate administration is needed, to keep records we are required to keep and to deal with any complaint, and to run our business, including maintaining our website and keeping our records accurate.

The legal bases we rely on are performance of a contract, covering your service and the steps you ask us to take before entering into it. Your consent, covering referrals to a panel solicitor and drawing on information held by Legacy Wills & Estate Planning Limited where you ask us to. Our legitimate interests, covering responding to enquiries, administering and improving our business and website, and keeping appropriate business records. Legal obligation, covering records and checks the law requires us to make and keep.

We do not use your information for automated decision making, and we will not send you marketing without your consent.

Who we share your information with

Panel solicitors. If you ask us to refer you for legal advice or full estate administration, we share the information needed for that referral with the panel solicitor, with your consent. From that point the solicitor is responsible to you for the information they hold, under their own terms and privacy policy. You are never obliged to use a solicitor we recommend, and if we receive any referral fee or benefit we will tell you before any referral is made.

Legacy Wills & Estate Planning Limited. If the will was written or stored with Legacy Wills and you ask us to, we will request relevant information from them so your family does not have to start from scratch. We only do this with your permission.

Search providers. Where an estate search forms part of your service, we share the details needed to run the search with our search provider.

Service providers. Our website, forms and booking system run on a hosted platform, and we use email and IT providers to run the business. These providers process information on our instructions and are not permitted to use it for their own purposes.

Others where the law requires. We may share information where we are required to by law, or to deal with a complaint or legal claim.

We do not sell your information.

How long we keep it

We keep enquiry and consultation details for up to 12 months from our last contact with you, so we can pick things up if you come back to us.

If you become a client, we keep your file for 6 years after your service ends, in line with the limitation periods that apply to professional services.

We then delete or anonymise the information securely.

Your rights

You have the right to ask for a copy of the information we hold about you, to have it corrected, to have it deleted, to restrict or object to how we use it, and to receive it in a portable format, in each case in the circumstances set out in data protection law. Where we rely on your consent, you can withdraw it at any time.

To use any of these rights, contact dataprotection@legacypep.co.uk. We will respond within one month.

If you are unhappy with how we have handled your information, you can complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113. We would welcome the chance to put things right first, so please consider contacting us before you go to the ICO.

Cookies

Our website uses only the cookies and similar technologies necessary for it to work, such as those that keep the site secure and make the forms function. We do not currently use advertising cookies. If that changes we will update this policy and ask for any consent the law requires.

Changes to this policy

We will update this policy when our practices change and show the date of the latest version at the top. Significant changes will be highlighted on this page.
